TERMS AND CONDITIONS OF USE

ART. 1 - DEFINITIONS

1.1. "Website" means the website www.patatinacerimonia.it, dedicated to the online sale of clothing products and accessories.

1.2. "Customer" means the natural or legal person who purchases products through the Website, accepting these General Terms and Conditions of Sale.

1.3. "Seller" means Patatina di Pavoncello Bruno, with registered office at Via Tuscolana 853D, 00173 Rome (RM), Italy, VAT No. IT17173451000.

1.4. "Order" means the purchase request submitted by the Customer through the Website.

1.5. "Products" means the goods offered for sale on the Website.

1.6. "Customized Products" means goods manufactured or modified according to the Customer's specific request.

1.7. "Price" means the amount due for the purchase of the Products, expressed in Euro and inclusive of VAT where applicable.

1.8. "Contract" means the distance-selling agreement concerning the sale of Products through the Website.

1.9. "Parties" jointly means the Seller and the Customer.

ART. 2 - SALE OF PRODUCTS

2.1. To place an order on the Website, the Customer must follow the online purchase procedure and accept these General Terms and Conditions of Sale.

2.2. The Contract shall be deemed concluded when the Customer receives the order confirmation at the email address provided during checkout.

2.3. The Seller reserves the right to refuse or cancel an Order in case of Product unavailability, technical errors, obvious pricing errors, anomalies in the Order, suspected misuse of the Website, or any other circumstance preventing proper fulfillment.

2.4. Customized Products are made upon the Customer's specific request. For such Products, the right of withdrawal is excluded, except in the event of defective, damaged, or non-conforming Products.

2.5. The Seller reserves the right to modify prices, descriptions, availability, and characteristics of Products at any time. Such modifications shall not affect already confirmed Orders.

2.6. If a clearly incorrect price is displayed due to technical, IT, or material errors, the Seller reserves the right to cancel the Order and refund any amounts already paid.

ART. 3 - DELIVERY TIMES AND METHODS

3.1. Products are delivered via express courier to the address provided by the Customer.

3.2. Estimated delivery times within Italy are generally 4–6 business days from Order receipt. These times are indicative only and may vary.

3.3. In the event of post-confirmation unavailability of one or more Products, the Seller may proceed with partial shipment of available Products after notifying the Customer.

3.4. The risk of loss or damage passes to the Customer when the Customer, or a third party designated by the Customer other than the carrier, physically takes possession of the Products.

3.5. Upon delivery, Customers are encouraged to inspect the package. If damaged, opened, or tampered with, acceptance with reservation or refusal of delivery is recommended.

ART. 4 - CUSTOMER OBLIGATIONS

4.1. The Customer undertakes to provide accurate, truthful, and complete information necessary for Order fulfillment.

4.2. The Customer is responsible for the accuracy of the information provided. The Seller shall not be liable for failed or incorrect delivery resulting from inaccurate information.

4.3. The Customer agrees to pay the Price of the purchased Products and retain a copy of the order confirmation.

ART. 5 - PRICE AND PAYMENT

5.1. All Prices are expressed in Euro (€) and include VAT where applicable.

5.2. The total Order amount, including shipping costs where applicable, is displayed before purchase confirmation.

5.3. Orders equal to or above the threshold indicated on the Website may qualify for free shipping within Italy.

5.4. Customs duties, import taxes, or other charges applicable outside Italy shall be borne by the recipient.

5.5. Payment may be made using the methods available at checkout, including credit/debit cards, PayPal, Klarna, Scalapay, cash on delivery (where available), or other methods indicated on the Website.

5.6. The Seller reserves the right to restrict or exclude specific payment methods for certain Orders, Products, locations, amounts, or Customers.

ART. 6 - FORCE MAJEURE

6.1. Neither Party shall be liable for delays or failures caused by events beyond its reasonable control, including strikes, natural disasters, health emergencies, transportation disruptions, technical issues, payment service interruptions, government actions, or force majeure events.

6.2. In such cases, performance deadlines shall be extended for the duration of the impediment.

ART. 7 - COPYRIGHT AND TRADEMARKS

7.1. Trademarks, logos, images, texts, graphics, content, and other distinctive signs displayed on the Website belong to their respective owners.

7.2. Unauthorized use, copying, reproduction, modification, or distribution of Website content is prohibited.

7.3. Unauthorized use may be prosecuted under applicable law.

ART. 8 - RIGHT OF WITHDRAWAL, RETURNS AND REFUNDS

8.1. Consumer Customers have the right to withdraw from the Contract within 14 days of receiving the Products, in accordance with applicable law.

8.2. The right of withdrawal applies exclusively to consumers and does not apply to resellers, companies, or VAT-registered professionals purchasing for business purposes.

8.3. To exercise the right of withdrawal, the Customer must notify the Seller within 14 days of delivery via email at info@patatinacerimonia.it or WhatsApp at +39 375 604 6906.

8.4. Customer Service will provide return instructions after receiving the request.

8.5. Products must be returned intact, unused, in perfect condition, complete with original packaging and tags. The right of withdrawal cannot be exercised if the original "Patatina Cerimonia" tag has been removed.

8.6. Products must be returned to: Patatina Cerimonia, Via Tuscolana 853D, 00173 Rome (RM), Italy.

8.7. Refunds will be issued approximately within 30 days after receipt and verification of returned Products.

8.8. Refunds do not include shipping costs unless otherwise required by applicable law.

8.9. Sale, promotional, or outlet items may be returned in accordance with applicable law. Exchanges remain subject to Product availability.

8.10. Defective, damaged, or non-conforming Products should be reported promptly, preferably within 7 days of delivery, including photos and a description of the issue.

8.11. For cash-on-delivery Orders, approved refunds are generally issued as store credit of equal value for future purchases.

8.12. Store credit will be issued after inspection of returned Products and communicated by email.

8.13. This represents the standard refund procedure for cash-on-delivery Orders. The Seller reserves the right to evaluate alternative refund methods in exceptional circumstances.

8.14. If a cash-on-delivery shipment is refused or not collected due to reasons attributable to the Customer, the Seller reserves the right to restrict future use of cash-on-delivery and request reimbursement of shipping and return costs.

ART. 9 - PRIVACY

9.1. Personal Data provided by the Customer is processed in compliance with Regulation (EU) 2016/679 (GDPR), Italian Legislative Decree 196/2003 as amended, and applicable data protection laws.

9.2. For further information, Customers may consult the Privacy Policy available on the Website.

ART. 10 - ENTIRE AGREEMENT

10.1. These Terms and Conditions, together with the Order, Order Confirmation, and all Website policies, constitute the entire agreement between the Seller and the Customer.

10.2. Amendments shall only be valid if published on the Website or communicated in writing.

ART. 11 - COMMUNICATIONS

11.1. Communications may be made via email, WhatsApp, postal mail, or other channels indicated on the Website.

11.2. Communications relating to the Contract may be made by email, registered mail, or other suitable means ensuring receipt.

ART. 12 - LANGUAGE

12.1. These General Terms and Conditions of Sale are drafted in Italian. Any translation is provided for convenience only.

ART. 13 - APPLICABLE LAW AND JURISDICTION

13.1. The Contract shall be governed by and interpreted in accordance with Italian law.

13.2. Any dispute involving a consumer shall fall under the jurisdiction of the court of the Customer's place of residence or domicile.

13.3. In all other cases, the Court of Rome, Italy, shall have exclusive jurisdiction.

ART. 14 - KLARNA PAYMENT

14.1. Klarna payment is available on the Website where enabled at checkout.

14.2. Customers may access immediate, deferred, or installment payment options offered by Klarna.

14.3. Customers choosing Klarna are redirected to Klarna's platform to complete the transaction.

14.4. The payment relationship is established directly between the Customer and Klarna. The Seller is not responsible for Klarna-related issues.

14.5. Customers must comply with payment deadlines agreed with Klarna.

ART. 15 - SCALAPAY PAYMENT

15.1. Scalapay installment payment is available where enabled at checkout.

15.2. Customers may receive Products immediately and pay in 3 or 4 interest-free installments where applicable.

15.3. Customers are redirected to Scalapay's platform to complete the purchase.

15.4. The contractual relationship is established directly with Scalapay. The Seller is not responsible for installment payment services.

15.5. Customers authorize Scalapay to automatically charge installments according to agreed deadlines.

15.6. Customers acknowledge that payment receivables may be assigned to Incremento SPV S.r.l. and related parties according to Scalapay's terms.

ART. 16 - CASH ON DELIVERY PAYMENT

16.1. The Website offers cash-on-delivery payment where available at checkout.

16.2. Cash on delivery is available exclusively for Orders delivered to Italy and San Marino.

16.3. Cash on delivery includes an additional fee of €5.00.

Cash on delivery limitations:

• Available only for Orders up to €999.00.
• Not available for Orders containing gift cards.
• May not be available for all Customers, Products, addresses, or locations.

16.4. Patatina Cerimonia reserves the right to disable cash-on-delivery payment for specific Customers, Orders, locations, or in the event of previous delivery refusals, uncollected Orders, abnormal returns, or abusive behavior.

16.5. Customers choosing cash on delivery undertake to be available to receive the Order and pay the courier upon delivery.

16.6. In case of unjustified refusal of delivery or failure to collect the Order, the Seller reserves the right to request reimbursement of shipping, storage, and return costs.
